Welcome to Matamna Homebuyers (legal name Matamna RE Inc, referred to here as "we," "us," or "our"). By accessing www.matamna.com or using our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully, including the arbitration provision in Section 20.

1. Acceptance of Terms

By using this website, you signify your acceptance of these Terms of Service. If you do not agree, please do not use our website. Your continued use of the site following the posting of changes will be deemed your acceptance of those changes.

2. Who We Are — Important Disclosure

We are real estate investors and direct buyers. We are not real estate agents or brokers, and we do not represent you in the sale of your property.

We buy property for our own account and for investment purposes. We owe you no fiduciary duty, we do not act as your agent, and we do not provide brokerage services. We are not acting on your behalf to market your property or to obtain the highest possible price for it. You are always free to list your property with a licensed real estate agent, to solicit competing offers, and to have any agreement reviewed by an attorney of your choosing before you sign it. We encourage you to do so.

3. Description of Services

Our website allows homeowners to request a cash offer for their property. We evaluate submitted properties and, at our discretion, may present a written purchase offer. We may also decline to make an offer for any reason or for no reason.

4. Offers Are Not Binding Until a Written Contract Is Signed

Any figure, estimate, range, or preliminary number we communicate to you by phone, text, email, or through this website is not a binding offer and does not create a contract. No obligation exists on either side unless and until both parties sign a written purchase agreement.

Offers are subject to property inspection, title examination, verification of ownership and authority to sell, confirmation of liens and encumbrances, and confirmation of the information you provided. Submitting information about your property does not obligate us to make an offer, nor does it obligate you to accept one.

5. Assignment of Contracts

Some properties we purchase, renovate, or hold ourselves. In other transactions we may assign our rights under a purchase contract to another buyer who closes in our place. Unless your contract states otherwise, purchase agreements with us are assignable.

Where we are selling or assigning an equitable interest in a contract rather than the property itself, Texas law requires that we disclose that fact to you in writing, and we will do so. This disclosure obligation arises under Section 1101.0045 of the Texas Occupations Code and Section 5.0205 of the Texas Property Code.

An assignment does not change the purchase price or the closing date stated in your signed contract. If you prefer that your contract not be assigned, tell us before signing and we will discuss whether we can accommodate that.

6. No Legal, Tax, or Financial Advice

Information on this website — including material about property taxes, exemptions, probate, foreclosure, Medicaid, insurance, or any other subject — is provided for general information only and is not legal, tax, financial, or medical advice. Laws and program rules change and apply differently to different circumstances. We are not attorneys, accountants, or financial advisors. Consult a qualified professional about your specific situation before acting on anything you read here.

7. No Fees or Commissions

We do not charge sellers fees or commissions for making an offer or for purchasing a property, and we pay standard closing costs customarily paid by the buyer in our market. Amounts owed by you to third parties — including mortgage payoffs, delinquent property taxes, municipal liens, judgment liens, HOA balances, and prorated items — are settled at closing from the sale proceeds. Your written contract and the closing statement prepared by the title company control in all cases.

8. Equal Housing Opportunity

We are committed to the letter and spirit of United States policy for the achievement of equal housing opportunity throughout the nation.

We buy, sell, and market residential property without regard to race, color, religion, sex, familial status, national origin, disability, or any other classification protected under the federal Fair Housing Act, the Texas Fair Housing Act, or applicable local law. We do not decline to make an offer, alter the terms of an offer, or otherwise treat a property or an owner differently on any of those bases. If you believe you have experienced housing discrimination, you may contact the U.S. Department of Housing and Urban Development or the Texas Workforce Commission Civil Rights Division.

9. Photographs, Examples, and Illustrative Content

Photographs on this website are illustrative and are not necessarily images of properties we have purchased. Cost figures, repair estimates, timelines, and examples are general illustrations based on typical North Texas conditions, not predictions about your property. Every house, every title, and every market is different. Nothing on this site should be read as a representation of what your property is worth or what we will offer for it.

10. No Guarantee of Offer, Amount, or Timeline

We do not guarantee that we will make an offer on any property, that an offer will reach any particular amount, or that a closing will occur by any particular date. References on this site to closing "in as little as 7 days" describe what is achievable in favorable circumstances, not a commitment. Actual timelines depend on title condition, lien payoffs, probate or authority to convey, survey and inspection needs, and third parties including title companies and lenders — some of which are outside our control. The terms of any specific transaction are governed solely by the written purchase agreement you sign.

11. User Conduct

You agree to use the website only for lawful purposes. You are prohibited from:

  • Providing false or misleading information about yourself or your property.
  • Submitting information about a property you do not own or have no authority to sell.
  • Attempting to interfere with the proper working of the website.
  • Using any automated system to access, scrape, or harvest data from the website without our permission.
  • Violating any applicable local, state, or federal law.

We reserve the right to terminate your access to the website for any violation of these terms.

12. Property Submissions and Accuracy

You represent that information you submit about a property is accurate to the best of your knowledge and that you are the owner or are authorized to act on the owner's behalf. If you are acting under a power of attorney, as an executor or administrator, as a trustee, or as a court-appointed guardian, we may require documentation of that authority before proceeding, and the title company will conduct its own review.

13. Communication Consent

By providing your contact information, you expressly consent to receive communications from us:

  • Phone calls and SMS: You agree to receive phone calls and text messages (SMS) from us regarding your property inquiry. These may be sent using automated technology, including an automatic telephone dialing system or prerecorded voice.
  • Email: You agree to receive emails from us regarding our services, property evaluations, and marketing updates.
  • Frequency: Message frequency varies based on your interaction with us.
  • Rates: Standard message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

17. Limitation of Liability

To the fullest extent permitted by law, Matamna Homebuyers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, arising out of or in connection with your use of our website or services, whether based in contract, tort, or any other legal theory. Nothing in these terms limits liability that cannot be limited under applicable law.

18. Indemnification

You agree to indemnify and hold Matamna Homebuyers harmless from any claims, losses, or damages, including reasonable legal fees, resulting from your violation of these terms, your submission of inaccurate information, or your use of the website.

19. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Venue for any matter not subject to arbitration lies in Dallas County, Texas.

20. Dispute Resolution and Arbitration

Please read this section carefully. It affects how disputes are resolved.

Any dispute arising out of these terms or your use of this website that is not resolved informally shall be resolved through binding arbitration administered in Dallas County, Texas, rather than in court, except that either party may bring an individual claim in small claims court. Before initiating arbitration, the party raising the dispute agrees to give the other party written notice and 30 days to resolve it informally.

Class action waiver. Disputes will be arbitrated on an individual basis only. You and Matamna Homebuyers each waive the right to participate in a class, collective, or representative action.

Your right to opt out. You may opt out of this arbitration provision by emailing info@matamna.com with "Arbitration Opt-Out" in the subject line within 30 days of first accepting these terms. Opting out will not affect any other part of these terms or our willingness to work with you. This section does not apply to the terms of any signed purchase agreement, which contains its own dispute provisions and controls over this section.

21. Privacy Policy

Your use of the website is also governed by our Privacy Policy, which is incorporated into these terms by reference.

22. Severability and Entire Agreement

If any provision of these terms is found invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full force. These terms, together with our Privacy Policy, constitute the entire agreement regarding your use of the website. Any signed purchase agreement between us controls over these terms with respect to a specific transaction.

23. Changes to Terms

We reserve the right to modify these Terms of Service at any time. The current version is always the one posted on this page, and changes are effective when posted. Your continued use of the website after a change constitutes acceptance.
